In a shocking case that made headlines in 2013, a British man found himself facing serious consequences after committing a crime and learning about a life-altering possibility.
Richard Thomas, 27, was convicted of raping a woman while she slept in her home. However, after his conviction, he learned that he might have contracted HIV from his victim, which added another layer of complexity to an already disturbing story.
The Crime and Its Consequences
According to the BBC, Thomas was sentenced to five years and four months in prison for his crime. The incident happened one night when Thomas admitted to drinking heavily and using cocaine and ecstasy. He couldn’t remember much of the evening due to the drugs and alcohol, but he accepted the woman’s account of what had happened.
The woman, who had taken a sleeping pill, was fast asleep when Thomas entered her home without permission. He walked into her bedroom and attacked her while she lay unaware.
She only woke up to the horrific discovery that Thomas was raping her. The woman was frozen with shock and fear. As the prosecution lawyer, Harry Pepper, later described, “She froze and no words were exchanged.” Thomas left after the attack, pulling up his shorts before exiting the scene.
A Troubling Discovery
Soon after his conviction, Thomas was informed that there was a possibility he could have contracted HIV from the woman. Thomas, in his defense, claimed that he was aware the woman had some kind of illness but didn’t know that it might be HIV.
When he learned about the potential risk, he reportedly passed out from shock. He was scheduled to take an HIV test to find out whether he had been infected, but the results were not immediately clear.
His lawyer, Virginia Hayton, mentioned that Thomas was deeply affected by the situation. “He’s troubled by it and regrets it,” she said. Thomas had a troubled past, with a history of drug and alcohol abuse.
He began using cannabis at the age of nine and started drinking when he was just 11. By the time he was 13, he was receiving treatment for addictions to cocaine and ecstasy. Hayton said that Thomas couldn’t understand why he had committed the crime, and he acknowledged that it was something he deeply regretted.
The Sentence and Legal Statements
The judge in the case, Mark Brown, delivered a stern sentence. He gave Thomas five years and four months in prison for the “dreadful offense” and permanently placed him on the Sex Offenders Register.
In defense of her client, Hayton tried to show that Thomas was genuinely remorseful for what he had done, despite the severity of his crime. She also pointed out that Thomas had no prior convictions related to rape or sexual assault, but his troubled history with drugs and alcohol made his actions even more complicated.
After hearing about the possible HIV risk, Hayton sent Thomas a few brief words of sympathy, acknowledging the heavy burden he now faced. “This [HIV test] has been hanging over his head,” she said. “He is to blame. He wouldn’t have put himself in this situation if he hadn’t done this crime.”
